Five leaders of the Proud Boys, including former chairman Enrique Tarrio, have initiated a $100 million lawsuit against the U.S. government, claiming their constitutional rights were violated during prosecutions related to the January 6, 2021, Capitol riot. The lawsuit, filed in Florida, alleges that FBI agents and prosecutors were motivated by personal biases, leading to unjust legal actions against them.

The plaintiffs—Tarrio, Biggs, Rehl, Nordean, and Pezzola—were previously convicted of charges including seditious conspiracy for attempting to obstruct the certification of the 2020 presidential election. They argue that their prosecutions involved evidence tampering and witness intimidation, constituting a corrupt and politically motivated process.

In January 2025, President Donald Trump issued a sweeping clemency order, pardoning nearly 1,600 individuals convicted for their involvement in the Capitol riot, including the five Proud Boys leaders now suing the government.
